(“CloudEva”, “we,” “us,” or “our”) has prepared this Privacy Policy to explain what personal information we collect, how we use and share that information, and your choices concerning our information practices in connection with our website Cloudeva.ai (the “Site”) and the AI-powered analytics and visualization platform made available through the Site (collectively, including the Site, the “Service”).

  • Social Media Information: We maintain pages on social media platforms such as LinkedIn, coX (Twitter), Medium, and other platforms (“Social Media Pages”). When you interact with our Social Media Pages, we may collect personal information you choose to provide. The platform providers may also share aggregated analytics with us.

  • Request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your Personal Data where you have exercised your right to object to processing.
  • Object to processing of your Personal Data. This right exists where we are relying on a Legitimate Interest as the legal basis for our processing and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your Personal Data for direct marketing purposes.
  • Request the restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of Personal Data about you, for example if you want us to establish its accuracy or the reason for processing it.
  • Request the transfer of your Personal Data. We will provide to you, or a third party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent. This right only exists where we are relying on consent to process your Personal Data (“Consent Withdrawal”). If you withdraw your consent, we may not be able to provide you with access to the certain specific functionalities of our Site. We will advise you if this is the case at the time you withdraw your consent.

4. Data Roles and Customer Data

  • For the purposes of applicable data protection laws, CloudEva acts as a Data Controller in respect of personal information relating to account creation, website usage, communications, and marketing, and as a Data Processor in respect of any data uploaded or submitted by customers through the Service (“Customer Data”).
  • Customer Data remains the property of the relevant customer. CloudEva processes Customer Data solely for the purpose of providing, operating, and improving the Services.
  • During the trial period, CloudEva processes only limited personal information necessary to provide access to the Service and applies reasonable technical and organizational measures to protect such information. For customers subject to applicable data protection laws, a Data Processing Agreement will be made available upon request.

5. How to Exercise Your Rights
If you want to exercise any of the rights described above, please email us at: support@cloudeva.ai. This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response. We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

6. Disclosure of personal information to third parties
We do not sell your personal information. In certain circumstances, we may share the categories of personal information described above without further notice to you, unless required by the law, with the following categories of third parties:

Vendors and Service Providers - To support our business operations and to provide the Service, we may share personal information with third-party vendors and service providers, including providers of hosting services, cloud infrastructure, data storage, web-hosting and server providers, information technology services, email communication and newsletter services, customer relationship management and customer support services, analytics providers, marketing or advertising service providers, professional advisors, maintenance or problem-solving providers, and payment systems operators. Such parties may access, process, or store personal information solely in the course of performing services for CloudEva and in accordance with our instructions and applicable confidentiality obligations.

Business Transfers - If CloudEva is involved in a merger, acquisition, financing or due diligence process, reorganization, bankruptcy, receivership, dissolution, sale of all or a portion of its assets, or a transition of services to another provider (each, a “Transaction”), personal information may be disclosed to counterparties and others assisting with the Transaction and transferred to a successor or affiliate as part of, or following, such Transaction.

9. Marketing

Where you opt out of receiving these marketing messages, this will not apply to Personal Data provided to us as a result of emails relating to purchases, subscription renewals and customer announcements relating to products/services such as technical notifications, service updates or other administrative communications.

10. No Special Categories of Personal Data
We do not collect any “Special Categories of Personal Data” about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

11. Data Retention
Customer Data processed through the Service will be retained only for as long as necessary to provide the Service. Where a customer has not subscribed to a CloudEva plan or where there has been no activity on the customer’s account for a continuous period of ninety (90) days, Customer Data may be deleted or anonymized, unless retention is required to comply with applicable law or to resolve disputes.

12. Link to other Websites
The Service may contain links to other websites not operated or controlled by us, including social media services (“Third-Party Sites”). The information that you share with Third-Party Sites will be governed by the specific privacy policies and terms of service of the Third-Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third-Party Sites directly for information on their privacy practices and policies.

13. Aggregated Information
We may aggregate personal information and use it for analytics, service improvement, and business insights. Aggregated data does not identify individual users.

We are committed to ensuring that the personal information we collect is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures such as the pseudonymisation and encryption of personal information, to safeguard and secure personal information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure. We cannot guarantee the security of any information that is transmitted to or by us over the Internet. The transmission and exchange of information is carried out at your own risk.
